It is no secret that TVCatchup has faced a bloody and long drawn out battle from several of the broadcasters, but few people have been aware that this battle has been fought on several major fronts.
Having successfully fought off accusations of illegality against TVC in the High Court brought by ITV together with a few of their more scurrilous and petty allies, few are even aware that the ever popular SKY felt left out and decided to try to jump on the bandwagon.
Whether it was an attempt at creating a safety net just in case the first attempt failed, or whether it was the pursuit of economic warfare – for everyone knows how deep the broadcaster's pockets are – will probably never be known. Few people are likely to ‘fess up that they have conspired to abuse the judicial system in such a blatantly contemptuous manner, especially after the News of the World fiasco.
Fresh on the heels of their epic loss in the case of FAPL –v- QC Leisure (the pub landlady case), the 28th February saw SKY taking a further hammering in court – this time from TVCatchup. And what a hammering they received for the second time, with Justice Floyd ordering that their case immediately be vacated (set aside) and all costs awarded to TVC.
Ordinarily that should be the end of things, we won, but they seem to have overlooked the little matter of settling the costs order against them. Presumably they have rather a lot of other things on their platter at the moment, but now it’s time for payback.
And that payback comes in the form of the rather quaint language of the Writ of Fieri Facias in the case HC10CO2250 issued today by the High Court against SKY by TVC:

IN THIS CLAIM it was on the 28th day of February 2012 ordered in this Court that the Claimants (British Sky Broadcasting Limited and British Sky Broadcasting Group PLC) do pay the Defendant (TVCatchup Limited) costs, which costs have been assessed and allowed at £15,942.25
YOU ARE NOW COMMANDED to seize in execution the goods, chattels and other property of the First Claimant authorised by law and raise therefrom the sums detailed in the Schedule, [together with fees and charges to which you are entitled.] and immediately after execution to pay the Defendant (TVCatchup Limited) the said sums and interest.
Does it really get any better than this?
